Scott Mitchell Fischer
Attorney Scott Mitchell Fischer of Morgan & Morgan has recovered hundreds of millions of dollars in cases against health care facilities. He has won multi-million-dollar verdicts and settlements against nursing homes, assisted living facilities and hospitals.
Scott is a double-Gator. He graduated from the University of Florida in 1997 and the University of Florida College of Law in 2000. He began his career by representing health care facilities, learning the inner workings of the health care industry. After a few years working for the defense, he switched sides and he has been representing victims and their families for over 20 years.
While the majority of Scott's cases involve bedsores, he also handles a variety of other cases involving victims of abuse and neglect. After bedsores, the second most common problem at health care facilities that leads to lawsuits are falls. Scott has successfully won a significant number of fall cases. One example is seen in the following video of Scott's closing arguments from a jury trial in West Palm Beach, Florida where Scott obtained a jury verdict of over nine hundred thousand dollars against a hospital for a patient who fell out of a hospital bed resulting in a broken hip:
In certain instances, health care facilities are permitted to avoid jury trials by forcing cases to binding arbitration instead. Scott has obtained stellar results for his clients in arbitration, winning binding arbitration awards totaling millions of dollars, including numerous successful bedsore case arbitrations. Health care facilities have fought for arbitrations to be resolved confidentially and secretly behind closed doors but Scott successfully fought back to prove that binding arbitrations should not be held outside the public eye. In 2024, Scott conducted the first ever binding arbitration case that was broadcast on the Courtroom View Network. Video of Scott's closing argument from that binding arbitration, which resulted in an award of over six hundred thousand dollars on behalf of a 95 year-old victim, can be seen in this video:
Scott has handled many cases that were publicized in the news media. Below are videos from multiple news stories, beginning with a news story regarding a six million dollar jury verdict Scott obtained against an assisted living facility in Port St. Lucie, Florida for the wrongful death of a 97 year-old:
